El PEH del Ayuntamiento de Madrid, aprobado definitivamente el 27 de marzo de 2019 (BOCM nº 95, 23 de abril de 2019), ha bloqueado las nuevas licencias de Vivienda de Uso Turístico (VUT) en prácticamente todo el Distrito Centro y gran parte de Chamberí, Salamanca y Arganzuela. The hybrid model: how 4 tenant profiles work
The key to temporary rental in Madrid isn't a single type of tenant but combination of four profiles That have different temporary windows and that, well severed, maintain a high-occupancy house throughout the year. We call this a full hybrid model.
1. Corporate (3–6 meses)
Consultants and managers relocated to projects with a defined duration. The company pays directly and thus the risk of non-payment is practically nil. The contract is signed by the company as a tenant or as a guarantor, monthly VAT invoice and the company applies retention of the 19% (model 115). The profile requires quality: symmetric fibre wifi, four star hotel level menage, desk with serious work chair. He's not price-picky because his company takes his place. Panic: September-October (start-up of annual projects, post-summer relocations) and energy-February (new projects). Barrio with more corporate demand: Chamartin, Salamanca, Chamberí, Fuencarral.
2. Graduate and resident MIR students (4-10 months)
Masters and MBas at IE, ESADE, IESE, Nebija, ESIC or CEU, Erasmus senior at public universities and MIR residents at reference hospitals. Stations match the academic course (June or May). The profile has verifiable collateral: family with an address in Spain, an institutional scholarship or a sponsorship company. Low risk of default. They are nongraduate students - they are training professionals with 28-38 years and actual budget. Barrio with highest demand: Moncloa, Argüelles, Chamberí (by the San Carlos Clinic and IE), Salamanca (ESADE).
3. Patients and accompanying patients (1-4 months)
Patients referred to the great university hospitals of Madrid from other autonomous communities and their accompaniments. They come with a documented medical cause, their stay is usually partially covered by insurance or family funds, and their profile is extremely careful with housing because their priority is treatment, and not leisure. The short stays of this profile (weeks to two months) are perfect to fill the gaps between long contracts. Barrios clave: Tetuan (La Paz), Chamberí (Clínica, Jiménez Díaz), Chamartin (Ramón and Cajal), Argüelles (Puerta de Hierro), Retiro (Gregorio Marañón).
4. families and professionals in transit (1-3 months)
Propietarios reformando su propia vivienda en Madrid, familias esperando entrega de llaves de una nueva compra, traslados laborales nacionales de corta duración, profesionales en proyecto concreto (compliance fiscal, M&A de ocho semanas, obra de tres meses). Estancias breves pero con el perfil de solvencia más alto: son propietarios o ejecutivos que tienen su propia vivienda en otro lugar y buscan comodidad puntual. Sin riesgo de ocupación permanente porque tienen su vida resuelta en otro sitio.
+ Airbnb and Booking in gaps (full hybrid)
If the housing is published on platforms with its autonomous registration, it also goes to Airbnb and Booking completely legally. The difference with a pure tourist accommodation is that for temporary rental the guest continues to sign an art contract. 3 LAU with justifiable time cause - isn't tourism. That allows us to complete with stays from five days to three weeks the gaps that are between long contracts, increasing the annual employment up to the 90-96% in the neighborhoods with highest demand. The additional income of these "lost" weeks can mean between 2.000 € and 6.000 € an extra year as per typology.
Do you need a tourist license? The real map of the PEH in Madrid
That's the question we get most often and the answer has two parts to understand separately.
The Special Hosting Plan (PEH) of the City of Madrid 27 March 2019 (BCMO No 95, 23 April 2019) was definitively approved with the aim of reducing the pressure of mass tourism on densiest residential neighborhoods. Its practical effect: it prohibits the granting of new Housing for Tourist Use (VUT) licences throughout the Centre District (Palace, Ambassadors, Cortes, Justice, University and Sun) and in most Chamberí, Salamanca and Arganzuela districts. In these neighborhoods, if your housing doesn't have an existing VUT license, you can't get it. Period.
Now the part that many owners don't know about: The HRP does not affect temporary rental. Temporary rental isn't tourist. It is covered by Section 3 of the LAU (Urban Leases Act), which regulates leases for different use from habitual housing. That's civil law, not tourism. The PEH, a local urban instrument, regulates regulated tourism activity, and does not regulate rental of the LAU. A owner in Malasaña, in Chueca or at the heart of Salamanca can conduct temporary rental art. 3 LAU with complete legality even though the PEH blocks VUT licenses on its street.
Temporary rental (art. 3 LAU) does not require a license or tourist registration number. The only care that, if housing is published on platforms such as Airbnb or Booking, these require number of autonomous tourist registration from your community (the single state registry that the RD 1312 / 2024 introduced into 2025 was cancelled by the Supreme Court in May of 2026), as we explain in the normative Section.
For owners with valid VUT license: The temporary and tourist hybrid model can be more profitable than pure tourism as it reduces operational costs (less cleanliness, less rotation, less wear) and stabilizes low season cash flow with mean contracts of two to four months.

2026: Article 3 LAU, SES.HOSPEDAJES and Platforms Registration
The legal framework of temporary rental in Madrid at 2026 has several layers to understand as a whole.
Article 3 of the AU - the legal basis
The Section 3 of Act 29 / 1994 of Urban Leases defines rental for use other than that of habitual housing. That's the legal figure that's protecting temporary rental. The difference with rental of habitual housing (art. 2 LAU) is crucial:
- No required extension. The contract expires at the agreed date. There are no 5 years of compulsory extension of habitual rental. If the tenant doesn't leave his place, his or her eviction is considerably faster and easier than his or her residential place.
- Freedom of pacts. Fijas tú la renta, la duración y todas las condiciones. No aplica el índice de contención de rentas ni el tope de actualización anual del 2%.
- The time cause is the key requirement. The contract should reflect that the tenant occupies the housing for a temporary and justifiable reason (moved work, studies, medical care and family care). Without documented cause, a judge could reclassify his contract as an habitual rental with all its consequences (extension, income ceilings, increased tenant protection).
Real Decreto 1312/2024 y el registro: qué queda tras la anulación del Tribunal Supremo
The Real Decreto 1312/2024 introduced to 2025 the single state register (NRUA). The Supreme Court put an end to this in May of 2026, so that state registry is no longer enforceable. For temporary rental the important nuance is double:
- Temporary rental (art. 3 LAU) never required permission or tourist registration number: it's civil rental, not tourist activity.
- What remains is the obligation of the platforms: The EU Regulation 2024 / 1028 requires Airbnb, Booking and similar to display a registration number for short-stay ads. Following the cancellation of the state registration, the valid identifier is the number of autonomous tourist registration from your community, and the platforms withdraw commercials that don't carry them.

SES.HOSPEDAJES - registration of passengers
Desde el 1 de enero de 2023 está en vigor el sistema SES.HOSPEDAJES del Ministerio del Interior, que obliga a todos los arrendadores (incluyendo alquiler temporal art. 3 LAU) a comunicar los datos de los viajeros antes de su llegada cuando la estancia es inferior a un mes. Para estancias superiores a 30 días, el régimen es distinto: el propietario registra al inquilino en el padrón municipal o en la Policía Nacional según el caso. En la práctica, el cumplimiento de SES.HOSPEDAJES es automático con el software de gestión que usamos (integración directa con Pricelabs y el canal de reservas).
Comunidad de Propietarios y el art. 17.12 LPH
Una duda frecuente: ¿puede la comunidad de propietarios prohibir el alquiler temporal? El artículo 17.12 de la Ley de Propiedad Horizontal permite que la comunidad, por mayoría de tres quintos, prohíba o limite la actividad turística en el edificio. Sin embargo, este mecanismo aplica solo a la actividad turística reglada (VUT). El alquiler temporal art. 3 LAU no es actividad turística y por tanto no puede ser prohibido por este mecanismo. Sí conviene revisar si los estatutos del edificio incluyen alguna cláusula específica de redacción previa a la LPH que pudiera afectar a arrendamientos no residenciales en general —es poco frecuente pero existe en algún edificio histórico.

- Autonomous registration (if we publish on platforms) and professional photography. Si el piso se va a anunciar en Airbnb o Booking, tramitamos el número de registro turístico autonómico que exigen las plataformas, en paralelo a la sesión fotográfica. En alquiler temporal, el inquilino reserva sin visitar el piso: las fotos son la visita. Una sesión profesional (luz natural, gran angular, edición) es la diferencia entre un piso que se alquila en tres días y uno que tarda tres semanas.
- Multichannel publication. Airbnb, Booking.com, our direct channel Tu Desvío and its own network of relocation managers. The relocation managers are RRHH coordinators of large companies with office in Madrid that manage their employee's movements: it's the fastest channel to get first and best retention corporate (the company returns if the tenant looks good).
- Filling and recruitment. Identification check, solvency check, validation of temporary cause. A contract drafted by our legal advice. Legal liability (two monthly) and, by profile, additional collateral (corporate bank guarantee, student family guarantee).
- Ongoing management. Clean and review among tenants, monthly dynamic training with pricelabs, Spanish and Spanish care 7 days, monthly report to the owner and active schedule management to avoid gaps of more than 10 days between contracts.

Near IE (Maria de Molina), ESADE (Prince of Vergara), UCM (University City), Copylas-ICADE (Camoens) or Nebija (Santa Cruz de Marcenado): The student profile of his post-graduate status is your pillar. The contract lasts for 8-10 months, employment is nearly complete and the risk of non-payment is low with family collateral. Barrio: Chamberí, Salamanca, Moncloa, Argüelles.

What's the difference between temporary and tourist rental in Madrid?
Son dos figuras jurídicas completamente distintas. El alquiler turístico (VUT) se rige por la normativa turística autonómica (Decreto 79/2014 de la Comunidad de Madrid, modificado por el Decreto 27/2026, de 25 de marzo, BOCM núm. 80, de 6 de abril de 2026) y requiere licencia de Vivienda de Uso Turístico. El alquiler temporal se encuadra en el artículo 3 de la LAU como arrendamiento para uso distinto de vivienda habitual: no requiere licencia turística, no está afectado por el Plan Especial de Hospedaje y se rige exclusivamente por la LAU y el Código Civil. Do you have to have a VUT license to rent in Madrid?
No. Temporary rental requires no Holiday Housing license. The VUT license is a requirement of autonomous tourism regulations and applies exclusively to tourist stays. The Special Hosting Plan of the town hall of Madrid, which blocks new VUT licenses in much of the municipality, doesn't affect temporary rental. Temporary rental does not require a tourist registration number, only if you publish on platforms such as Airbnb or Booking these require an autonomous tourist registration of your community, we conduct.
Do I need a registration number for temporary rental?
