What's temporary rental and why it's completely legal
Temporary rental is regulated at Section 3 of Act 29 / 1994 of Urban Leases as "rental for non-housing use." Madrid does not set minimum and maximum duration: what legally qualifies the figure isn't the length of his stay but rather the tenant attests a Temporary cause to justify that the housing isn't his habitual residence. For this article, this cause is medical treatment and is documented with hospital report or referral document from the health administration of origin.

Three relevant legal consequences:
- Freedom of pacts. Income, duration and conditions are agreed to by each contract at market prices. The end of the 2 % and the required five-year extension of the residential area do not apply.
- No tourist license. The rental to patients operates under the LAU and does not run under autonomous tourism regulations. The Special Hostiage Plan of the town council of Madrid doesn't affect him.
- Regional tourist registration (only if published on platforms). El alquiler temporal (art. 3 LAU) no necesita licencia ni número de registro turístico. El registro único estatal (NRUA) que el RD 1312/2024 introdujo en 2025 fue anulado por el Tribunal Supremo en mayo de 2026, así que ya no es exigible. 1. Families with minor in pediatric oncology
El sub-perfil con estancias más largas y emocionalmente más exigentes. El menor recibe tratamiento en el Niño Jesús (oncología infantil, hemato-oncología pediátrica), La Paz pediátrico (oncología y neurología infantil) o 12 de Octubre pediátrico. La familia completa se desplaza durante 1–6 meses según el ciclo de quimio o radio. Suelen necesitar piso de 2–3 habitaciones cerca del hospital, con cocina equipada para preparar dietas específicas, electrodomésticos completos y, idealmente, terraza o luz natural. Renta 2.500–4.000 €/mes según tipología y zona. Existen también convenios con fundaciones (Aladina, Pequeño Deseo, Cris Contra el Cáncer) que cubren alojamiento.
2. Adults undergoing oncological care with accompaniment
El sub-perfil más frecuente y el de demanda más estable. Pacientes adultos en quimioterapia, radioterapia o ensayos clínicos con tratamiento pautado de 1–4 meses en La Paz, 12 de Octubre, Gregorio Marañón, Clínico San Carlos, Ramón y Cajal, La Princesa o Jiménez Díaz, casi siempre acompañados por cónyuge, hijo adulto o hermano. Buscan piso de 1–2 habitaciones tranquilo, próximo al hospital correspondiente (≤25 minutos en transporte público), con buena luz, electrodomésticos completos y limpieza programada. Renta 1.750–2.800 €/mes según hospital y tipología.
3. Postoperative transplant patients
Trasplante pulmonar (Puerta de Hierro Majadahonda como referencia nacional), trasplante hepático (La Paz, 12 de Octubre, Gregorio Marañón), renal (La Paz, 12 de Octubre, Marañón), cardíaco y de médula. La fase post-operatoria exige al paciente vivir cerca del hospital durante 2–3 meses con controles muy frecuentes. Suelen viajar con un acompañante. Buscan piso de 1–2 habitaciones bien ventilado, fácil de mantener limpio, próximo al transporte que los lleve al hospital sin trasbordos. Renta 1.900–2.900 €/mes.
4. Accompanying and family in long stay
Cuando el paciente está hospitalizado en planta durante semanas (UCI prolongada, recuperación de cirugía mayor, oncológico complejo), la familia necesita base operativa cerca del hospital sin reservar el piso completo necesariamente para el paciente. Estancias 2 semanas–3 meses, una o dos personas adultas, tipología estudio o 1 habitación. Renta 1.400–2.100 €/mes. Es el sub-perfil más sencillo de gestionar y el que mejor encaja en pisos pequeños.
The best mix of flats close to reference hospital: demand base continues throughout the year by combining the four sub-profiles with peaks in enero-February (after Christmas) and September (new referral season). The summer remains an activity because oncological and transplant pathologies aren't expecting. Projected Annual Occupation: 89 %-95 %.
+ Airbnb and Booking in gaps (full hybrid)
If the flat is published on platforms with its autonomous registration, it goes legally Airbnb and Booking. It's not tourism here: the guest who reserves sign an art contract. 3 LAU with time-proof cause. These platforms are an additional channel to fill short gaps between two long hospital stays with families that come to a one-day or two time monitoring, attending medical congresses at IFEMA, training health care professionals or guest researchers. Temporary rent patients are mean weighted monthly gross income by combining the four sub-profiles with shorter stays Airbnb / Booking in gaps. Applicable Regulation (April 2026)
Five points to fulfill at the foot of the letter if the tenant is patient or accompanying:
- Written contract with documented medical cause. Annex to the contract: hospital report or referral document signed by the autonomous community of origin indicating intended duration of treatment. Without documentation of the case, a judge could reclassify his contract as a habitual rental with a compulsory extension of five years.
- Regional tourist registration (only if published on platforms). The single state registration was annulled by the Supreme Court in May of 2026 and what remains is that Airbnb and Booking demand an autonomous registration number from your community and withdraw an announcement without it (EU Regulation 2024 / 1028).
- Loan and collateral commensurate with profile. Two monthly bail (Section 36 LAU). For patients with accredited regional compensation or private insurance that cover accommodation, bimonthly payment in advance is often accepted as an additional guarantee.
- Retention of the owner's IRPF. At this sub-profile the tenant is usually a person (patient or family person signing his or her own with his or her own automa compensation) and so his or her owner declares his or her full income at his or her IRPF. If a private fund or insurance that sign as a tenant interacts, that legal entity applying retention of 19 % using model 115.
- Community of owners. Section 17.12 of the LpH allows to veto tourist activity by a majority of 3 / 5 and temporary rental to patients isn't tourist and cannot be vetted by this mechanism. The statutes should be revised if there was a specific clause about temporary use.
How we work: complete process (with hospital filter)
From signature to first patient, the mean term is 12- 18 days - in this profile we are especially agile because the derivations often come at short notice.
- Visits and valuation with hospital focus. Let's go to the ground and measure the actual public transport time to the nearest reference hospitals. We identify what sub-profile fits: if you are close to the child Jesus or paediatric of La Paz, families with minor in oncology; if you are close to Marañón or Clinical, adult oncology; if you are close to Iron Gate, after-transplant.

Is a Airbnb more profitable than renting patients to Madrid?
Depende del barrio y de la cercanía al hospital. Un VUT puro bien gestionado en Salamanca, Retiro o Centro genera 36.800–55.200 € brutos anuales para 2 habitaciones, pero implica 40–60 días de vacante, comisiones OTA del 15–18 %, 40–80 limpiezas anuales y desgaste alto. Un temporal sanitario rinde 26.200–37.700 € brutos con sólo 15–35 días de vacante, 4–6 limpiezas al año, perfil cuidadoso y sin licencia turística. En neto, el temporal sanitario queda al 70 %–80 % del VUT pero con muchísima menos operativa, con prepago vía indemnización autonómica y aportando una función social que muchos propietarios valoran.
What if the patient's treatment takes longer than intended?
Let's put them into the contract. Standard clause: The tenant can extend his stay for additional months with notice of 15 days, keeping the same rent or with an agreed adjustment. If the original contract was 3 months and treatment is extended to 5, simply an extension annex will be signed. If the next corporate or student tenant was already booked, we move him to another floor of our wallet or re-place him. That flexibility was just what families undergoing treatment valued best.
What if the patient dies during his stay?
That's a delicate situation we anticipate contrcurrently. The contract provides for advance termination as a result of force majeure with notice of 15 days and proportional return of the unconsumed monthly and bail. Operatively, we manage the closure with as best human sensitivities as possible - in these cases we are the ones who deal with the family, never the owner, so that the moment will be as best accompanied as possible.
What about cleanup? Are there health risks?
No, except very specific cases that are handled separately. The vast majority of patients with cancer, post-transplant or undergoing rehabilitation have no infectious pathology. Cleanup at change is made with standard hypoallergenic products and, optionally, with increased disinfection if requested by the incoming family. Patients with infectious risks are usually hospitalized or referred to specific health care care homes, and not temporary rental.
Can patients be published at Airbnb and Booking?
