What's a VUT?
One housing for tourist use It's a complete housing that's given up furnished and equipped for short stay, commercializes through tourist channels and is registered with the tourism register of its autonomous community. It's not the same as a tourist apartment (that's an establishment with several units and its own system) or that's temporary rental without tourist licenseand does not require a tourist license.
Each autonomous community has its own rule: its surface and equipment requirements, its procedure - in nearly all, its responsible declaration - and its registration. On top of this there's a state shortterm rental registration and an obligation to report information from passengers. And under, the town's ordenance, which in several cities today is the one that really decides whether or not to operate.

VUT Regulation in Spain: All about Tourist Licences

En España, el alquiler turístico (VUT) se regula en tres capas: autonómica (cada CCAA tiene su propio decreto — Madrid Decreto 79/2014, modificado por el Decreto 27/2026, de 25 de marzo (BOCM núm. 80, de 6 de abril de 2026), Castilla y León 3/2017, Andalucía 31/2024, Cataluña 75/2020, etc.), estatal (SES.HOSPEDAJES para parte de viajeros; el Número de Registro de Arrendamientos del RD 1312/2024 fue anulado por el Tribunal Supremo (STS 620 / 2026, May of 2026)) and town (urban plans, moratoriums, zoning). Any housing intended for tourist rental requires an autonomous registration before being published at Airbnb, Booking or any platform.
What's VUT regulations?
The Housing for Tourist Use (VUT) is the figure with which most autonomous communities regulate rental of complete housing to tourists for short stays, normally less than 31 days. Each CAA has its own name and regime: VFT in Andalucía, HUT in Catalonia, ETV in Balearic Islands, VV in Canary Islands, VUT in Madrid, Castile and León, Cantabria, Castilla-La Mancha and most of the rest. The Act 29 / 1994 of Urban Leases (LAU) expressly excludes from its scope the temporary assignment for tourist purposes, leaving the regulations to the autonomous.
From 2024-2025, two state layers were added on the autonomous regulation: SES.HOSPEDAJES (police registration of passengers, RD 933 / 2021) and Unique Retirement Register (NRA) (RD 1312 / 2024), que arrancó en julio de 2025 y fue anulado por el Tribunal Supremo (STS 620/2026, mayo de 2026). It's important to distinguish VUT from other figures that sometimes get confused:
- Tourist Apartment (AT): complete building intended professionally for tourist accommodation with different category and requirements.
- Rural house: accommodation in rural environments with specific architectural and landscape requirements and different regulations for each CAA.
- Temporary rental (art. 3 LAU): rental for non-housing use, for stays of 32 days to 11 months with probable temporary cause (work, studies, health). No tourist license required and it's valid in VUT moratorium zones. See Temporary rental guide.
Types and modalities of leave
There are four administrative schemes under which a VUT can be legalised in Spain, depending on the ACABQ and the municipality:

In zones with a moratorium, the alternative law means temporary rental of art. 3 LAUThat does not require a tourist license and allows to operate with income close to those of the VUT model by combining profiles of tenant (corporate, student, health and families in transit).
How Regulation affects Profitability
The regulatory regime has a direct and often undervalued economic impact on a VUT. There are three mechanisms to be taken into account before buying or starting a housing:
- License transfer value. En zonas con moratoria (Barcelona, centro de Madrid bajo PEH, Palma), la licencia VUT existente se ha convertido en un activo separado de la vivienda, con un valor de mercado que oscila entre 20.000 € y 120.000 € según localización. Comprar una vivienda con licencia ya activa puede tener sentido; perder una licencia vigente (por no operar durante un periodo largo, por sanción grave, o por venta mal planificada) supone destruir ese valor.
- Withdrawal of ads without registration number. Airbnb, Booking, VRBO and Expedia withdraw ads that do not show the autophone registration number. A retreated announcement loses its historic ranking and can take weeks to get it back if re-published with a direct impact on income.
- Economic sanctions. The amounts to be operated without registration vary by CAA: up to 300.000 € in Madrid, 600.000 € in Catalonia, 400.000 € in Andalucía. The Inspection crosses data with Fairy, Airbnb and the cadastre, so to detect an undeclared VUT is growing faster and faster.
According to the latest information from INE, España superaba en 2025 las 350.000 VUT declaradas, con crecimiento anual de dos dígitos en la mayoría de destinos urbanos. El endurecimiento normativo no ha frenado la oferta legal, pero sí ha desplazado la actividad hacia gestoras profesionales capaces de asumir el cumplimiento.

How to process step by step license
The concrete procedure depends on ACABQ. Following, the general sequence applicable to most regimes with a responsible declaration (Madrid, Castilla and León, Castilla-La Mancha, Cantabria, Galicia and Asturias).
- Check urban viability. To request from the town council a certificate or consultation of compatibility of tertiary use - accommodation for the concrete farm. That step prevents them from submitting a statement that will later be inadmissible. In Madrid capital, at the Centre District, this is especially critical for the Special Plan of Hostidage.
- To review the statutes of the owners' community. From 2023, Section 17.12 of the Horizontal Property Act allows communities to veto VUT activity by a majority of 3 / 5. If your building has already vetoed it, activity cannot start.
- Prepare the documentation. Title of ownership, matchboard or first-term license, energy efficiency certificate, liability insurance (required by several CAA), claims sheets, signage. At CAA with categories (Castilla - La Mancha, Cantabria), figure out what level they have.
- To submit the responsible statement. by electronic headquarters of the ACABQ or physical registration. In Madrid, through the General Directorate of Tourism, in Castilla and León, Counsellor of Culture and Tourism and at every CCAA the appropriate window. A provisional registration number is obtained immediately.
- The Retirement Registration Number (NRA) will no longer be required. Since July of 2025 and requested Unite Digital Window of the Ministry of Housingbut the procedure was annulled by the Supreme Court (STS 620 / 2026, May 2026). The number that has to appear in your commercials is the autonomous.
- Fitted at SES.HOSPEDAJES.@@ Registration of the incumbent as an obligation to report information from passengers at police platform. It can be integrated with pms (Lodgify, Beds24, Smoobu, etc.) or be manual if the volume is low.
- Include registration numbers in all ads. Airbnb, Booking, VRBO, Expedia and direct channel: The autophone registration number has to be visible in public announcement. Without him, the platforms remove the list.
- Tax enforcement. Higher at Finance as per modality (income from capital or economic activity if hotel services are offered). VAT review if applicable.
Common errors that invalidate processing: to submit the declaration without having been established by the community of owners, to have an energy efficiency certificate attached, to use expired matchboards, to start an announcement before they have an autonomous registration number, to forget the required signage in several CAA.

- Do I need a license to rent my place at Airbnb?
- Yeah. In Spain, VUT registration number is required before housing is published at Airbnb, Booking or VRBO. The regulations vary across the Autonomous Community but they require some form of liability or prior leave. Platforms are required to withdraw notices without registration number as required by competent authorities.
- How do I conduct the VUT license in Madrid?
- In the Community of Madrid, the process begins with a responsible statement to the town council of the town where the housing is situated. The housing should then be registered with the Tourist Business Registry (RVAT) of the Community of Madrid. The registration number obtained should be shown in all OTAs. The process can take between 2 and 8 weeks depending on municipality and administrative burden.
- How much does the Spanish tourist license cost?
- El coste varía según la Comunidad Autónoma. En Madrid, el registro en el RVAT es gratuito, aunque puede haber tasas municipales adicionales. En Castilla y León la tasa de inscripción ronda los 50-100€. Los costes de asesoría para gestionar los trámites oscilan entre 300€ y 800€ según la complejidad del caso y si requiere informe urbanístico previo.
- What if I rent without a tourist license?
- Operar una VUT sin licencia puede acarrear sanciones muy elevadas. En la Comunidad de Madrid las infracciones graves pueden alcanzar los 300.000€. Las plataformas están obligadas a retirar anuncios sin número de registro cuando la administración lo requiera. El propietario puede ser responsable solidario si la explotación ilegal la realiza una gestora en su nombre sin haber obtenido los permisos pertinentes.
- What communities have moratoriums or restrictions on tourist rental?
- Las zonas con mayor restricción para nuevas VUT en 2026 son: Barcelona capital (moratoria total + extinción programada de todas las HUT en 2028 según Decreto-ley 3/2023), centro de Madrid (Plan Especial de Hospedaje, aprobado definitivamente el 27 de marzo de 2019, BOCM nº 95, 23 de abril de 2019, que sólo permite acceso independiente), Palma de Mallorca y zonas saturadas de Baleares (cupo de plazas cerrado), San Sebastián casco antiguo, algunas zonas de Valencia y Alicante bajo el Decreto-ley 9/2024, de 2 de agosto de Comunidad Valenciana. Canarias endureció su regulación con la Ley 6/2025, de 10 de diciembre, de Ordenación Sostenible del Uso Turístico de Viviendas. En zonas con moratoria, la alternativa legal es el alquiler temporal del art. 3 LAU, que no requiere licencia turística.
