To rent for short stays and with guest rotation type tourism without the corresponding autonomous registration is an administrative violation throughout Spain with sanctions ranging from hundreds to tens of thousands of dollars depending on the community. If you have no license today, you have three legal departures: rent per season under the art. 3.2 from the LAU - without a tourist license but with its own rules - give up the flat income housing to a company that processes the leave or you conduct the leave in your community. There's no fourth legal midway.
What's tourist rental and what's not
The tourist rental is the devoting of a complete housing for days or weeks, with frequent inputs and departures, key management and interstay cleaning and publication on platforms such as Airbnb or Booking. It's that rotation - not the exact duration - that makes an independent community consider it a tourist activity and demand registration. In front are the long term rental of life (art. 2 from the LAU, regular and permanent housing) and the seasonal rental, which occupies an intermediate space: it's not tourist but it's also the habitual housing of the tenant.
What if you rent an unlicensed day
If you advertise and rent your place for short stays without an appropriate autophone registration, you are committing an administrative violation, regardless of how far the guest arrives. The autonomous communities have been strengthening inspections at 2026 - passing data with platforms, denouncing communities from neighbours, monitoring active advertising without registration number - and the sanctions range from warnings and minor fines to high amounts of serious and serious violations, according to each community's tourism law. To that added the risk that the platform will withdraw your announcement if you notice that you have no record, also losing the accumulated reviews. Before we take that risk, look at all three legal alternatives.
Alternative 1: season rental (LAU)
The art. 3.2 from the LAU (Ley 29/1994) reconoce como "arrendamiento para uso distinto del de vivienda" los contratos "celebrados por temporada, sea ésta de verano o cualquier otra". Es la vía más directa si tu inquilino tiene un motivo real y no turístico para quedarse un tiempo: un desplazamiento laboral, unos estudios, una reforma en su vivienda habitual. No necesitas licencia turística ni registro autonómico, pero a cambio tienes que jugar según sus reglas, no las de un hotel:
- The contract should reflect the reason for the season and should not simply set a date.
- That's an indication of law fraud and can be reclassified as a tourist by the autonomous community or by a judge with the same consequences as rent without a license.
- No guest rotation every few days: it's a single tenant during the agreed season.

Alternative 2: Fixed income with company
If what you want is a real tourist housing - with the rotation and income that that allows - but you don't want to be the one to conduct registration and to take up the risk of employment, the fixed income changes who does what: you sign a lease with a company as Bliss, that becomes an effective tenant and operator of the house. And normally with your permission expressed in the contract, who processes the tourist registration if your town permits: manages the announcement and responds to the administration. It's not "rent without a license": it's transferring an obligation to conduct it to the person who operates the housing.
Alternative 3: get your license out in your community
If you prefer to keep track of the announcement and variable income, the direct path is to conduct the tourist registration in your autonomous community. Can I rent my place for a day at Airbnb without a tourist license?
No. To publish a short-stay housing with guest rotation on platforms such as Airbnb or Booking without an appropriate autoregistration (VUT, VV, HUT, ETC or VFT depending on the community) is an administrative violation throughout Spain, regardless of whether the platform will let you publish the announcement.
Is season rental the same as tourist rental?
No. The season rental is regulated by art. 3.2 of Act 29 / 1994 of Urban Leases (LAU) and requires that a tenant have a different motif from that of tourism - work, studies, a work in his habitual housing - and a stay of a certain duration, with no loose nights with check-in and check-out as at a hotel.
