Why Justice works so well for temporary rental

Justice is a sub-district of the centre with about 16.000 inhabitants. It includes Chueca and Count Duque and limits to the north with Almagro (Chamberí), to the east with Castellana and to the south with Gran Via. Streets such as Genoa, Hortaleza, Fuencarral Norte, Pelayo, San Marcos, Plaza de Chueca and Conde Duque make up a dense urban fabric with a rare mix: high residential, corporate office, embassies, political headquarters, law toptier and at the same time a vibrant cultural and commercial life with cosmopolitan profile.

La demanda corporate llega de forma muy concentrada: la zona de Génova alberga sedes de partidos políticos (PP entre otros) y oficinas corporativas, los bufetes top-tier están a tiro de piedra (varios de los más prestigiosos de España con sede entre Génova y la Castellana), y las embajadas (Reino Unido, Estados Unidos, Francia y muchas otras) están en la Castellana próxima o ya en su misma extensión. Toda esta actividad genera flujos constantes de profesionales desplazados de 3 a 6 meses. La parte académica también está cubierta: la sede del IE en María de Molina queda a unos 15 minutos en metro y la facultad de Filología de la UCM (Argüelles) a 10. La parte sanitaria, por el Princesa University Hospital (Diego de León, 10 minutes by metro), one of Madrid's most prestigious in oncology, neurology and other specialities.

The crucial structural factor, as with the rest of the Centre District, is Special Hosting Plan: new VUT licences are practically inaccessible. For an owner with a Justice floor, temporary rental isn't an alternative to Airbnb - it's the only legal means to operate housing in tourism + and to gain a higher return than residential without taking a regulatory risk. The fact that Chueca is also an iconic LGBTQ + neighborhood does not add a different profile for temporary rental: it adds a cultural and environmental value that many international profiles explicitly value while choosing accommodation in Madrid.

What's temporary rental and why it's completely legal

The temporary rental is listed at Section 3 of Act 29 / 1994 of Urban Leases under "rental for non-housing use." Madrid does not require minimum and maximum duration by law: what defines the figure isn't the length of the stay but that the tenant attests a Temporary cause to justify that the housing isn't his habitual residence. The four reasons we accept and document as a contract: work moved, studies, medical care and family transfer.

That's why the full hybrid model:: The same housing can operate with mean temporary contracts (3-10 months) and, in gaps, with shorter rooms reserved via Airbnb and Booking as long as the guest remains with an attable temporary cause. The key isn't duration: it's documentation.

Tres consecuencias jurídicas relevantes para ti:

  1. Freedom of pacts. You set rent and duration and conditions. Do not apply the end of the 2 % and the obligatory extension of 5 years of residential rental.
  2. No tourist license. Justice is within the centre and therefore under VUT restriction from the PEH (final approval of 27 March 2019, BomC No 95, 23 April 2019) but temporary rental operates under the LAU, not under autonomous tourist regulations. That blockade doesn't affect you as a temporary owner.
  3. No tourist registration number. Temporary rental (art. 3 LAU) does not require a license or tourist registration number. The single state registration (NRUA) that RD 1312 / 2024 introdujo en 2025 fue anulado por el Tribunal Supremo en mayo de 2026, así que ya no es exigible. The hybrid model: the four profiles that cover the year in Justice

The model's strength isn't dependent on a single profile. The four segments are especially well represented with the diplomatic and political and legal ecosystem of the neighborhood.

1. Diplomatic and Professional Corporate (3-6 months)

Professionals assigned to embassies (UK, USA, France, Germany, etc.) who require accommodation while processing their final residence, parliamentary and technical counselors rotating between Genoa and the Senate, law enforcement lawyers toptier in long projects (M & A, regulatory compliance, arbitrations), international journalists and correspondents that cover the Spanish political agenda. Companies or institutions pay bills, risk of default very low. A high quality and very stable profile.

2. Graduate Students and International Programs (4-10 months)

EI Manners (a 15 minutes by Justice Tube), international programs with practice in Madrid, UCM Philology and other faculties from Argüelles to 10 minutes walk, Spanish schools with an executive and diplomatic profile (profile that especially values the area), Erasmus that prioritize cosmopolitan environment. Reportable family or scholarship as collateral.

3. Patients and accompanying patients (1-4 months)

The Princesa University Hospital (Diego de León) is at 10 minutes by metro and is one of the most prestigious hospitals in Madrid in oncology, neurology and other reference specialities. To the north remains the hospital of the King (Cardinal Cisneros). Both result from patients throughout Spain who require stable accommodation during treatment. Prepaid or supported living conditions, very carefully profile with housing.

4. families and professionals in transit (1-3 months)

Reforms to their own families, international partners that value a cosmopolitan and tolerant environment for their transition to Madrid, dedicated project professionals (pitchers, M & A of 2 months, audits), investors that evaluate the town. A short, solvent and fast-rotating profile.

The ideal sequence at Justice: and law enforcement in fall, Postgraduate students at course start, Health and traffic in gaps and shortcuts through portals for loose days. Well orchestrated, this sequence production an annual occupation of the 88-94 %.

+ Airbnb and Booking in gaps (full hybrid)

If the flat is published on platforms with its autonomous registration, the housing is also published in Airbnb and Booking completely legally. The difference with a pure VUT is that at temporary rental the guest continues to sign an art contract. 3 LAU with justifiable time cause - isn't tourism. That makes it possible to cover the free weeks between two long contracts with short stays (5 days to 3 weeks) of project professionals, patient families, guest researchers or parliamentary advisors who come to regular sessions. Result: Occupation close to the 100 % and an additional high season entrance with no tourist license.

Renta temporal es renta bruta media ponderada anual (combinando los cuatro perfiles). El diferencial neto tras gestión y gastos depende del modelo: en Gestión Integral de Bliss Homes, la comisión media en alquiler temporal es del 15–18 %+IVA; los gastos operativos (limpiezas entre inquilinos, suministros, mantenimiento menor) suman un 6–10 % según uso.

Regulation applicable to Justice (May 2026)

Those are the concrete points to fulfill at the foot of the letter:

  • A contract with an attestable temporary cause. The basic requirement: the cause (work, studies, health and family transfer) should be found in the contract and, where possible, be documented (letter of conduct or embassy, parliamentary accreditation, registration of the centre, medical and work document). No minimum or maximum duration by law. What deludes the figure is the cause. Without documented cause, a judge could reclassify his contract as a habitual rental of housing.
  • Regional tourist registration (only if published on platforms). The single state registration was annulled by the Supreme Court in May of 2026 and what remains is that Airbnb and Booking demand an autonomous registration number from your community and withdraw an announcement without it (EU Regulation 2024 / 1028).
  • Legal and additional guarantees. Two monthly leave (Section 36 LAU) and, according to the profile, additional guarantee: corporate bank guarantee, family guarantee for students, prepaid for health profile.
  • Retention of the owner's IRPF. If the tenant is a legal person, the company retains the 19 % on income (model 115). If you are a natural person, you declare full income. Diplomatic tenants have to be reviewed on a case-by-case basis (some are governed by bilateral agreements).
  • Community of owners. Article 17.12 LpH allows to veto tourist activity by a majority of 3 / 5 and temporary rental isn't tourist and cannot be blocked by this mechanism. Statutes should be revised if there is a specific earlier clause.

How we work at Justice: complete process

From sign to first tenant, our standard process is 15-21 days.

  1. Visits and valuation. Let's go to the ground, we value real demand on the street (it's not the same Génova-Almagro with political headquarters as Chueca's heart or Count Duque's axis) and we identify what profile will dominate your building.
  2. Equipment. If the floor is empty or very fair to suit, we give you concrete list with an investment estimate (1.500-4.000 € for 2 floor) and we will have to buy and mount them if you prefer. At Justice we give special care to style and design: the international profile explicitly values aesthetic care at the floor.
  3. Autonomous registration (if we publish on platforms) and professional photography. If the flat will be advertised at Airbnb / Booking, we process the number of autonomous tourist registration required by the platforms, in parallel with the photo session (3 days). At temporary rental the guest reserves without a prior visit, so photos are determining.
  4. Multichannel publication. Airbnb and Booking (with an autonomous registration demand), Bliss Homes direct channel and network of relocation diplomatic and corporate managers. We set up the platforms so that they only accept reservations with an attested temporary cause.
  5. Filling and recruitment. We check his identity, his solvency and his temporary cause. A contract drawn up by our legal advice (Spanish and Spanish versions as applicable). Loan and, as appropriate, additional collateral.
  6. Ongoing management. Cleanup among tenants, monthly dynamic training with pricelabs, Spanish and English care, monthly report to the owner and co-ordination with the next candidate 30 days before contract end.

Honest comparison: temporary vs. tourist vs. residential with Justice

There's no "better" model in abstract. A better model exists for each owner, depending on risk tolerance, financial situation and time horizon. That's the table we use as we review each case. In Justice, as in the rest of the Center, we have to bear in mind that pure VUT is rarely a real choice for new licences.

The full model hybrid temporary rental es el que se queda con todas las partes buenas del pastel y descarta las malas. Combina la rentabilidad alta del turístico (Airbnb y Booking publicados legalmente con el registro autonómico que exigen las plataformas y estancias cortas en huecos), la seguridad jurídica del residencial (contrato firmado, fianza depositada, perfil filtrado, sin riesgo de okupación habitual) y la estabilidad operativa de tener 3–5 inquilinos al año en lugar de 60. Is it more profitable than a Airbnb in Justice?

El problema en Justicia es que la mayoría de pisos no pueden ser Airbnb legalmente debido al PEH. Para los pocos con VUT vigente, un VUT puro bien gestionado rinde entre 36.500 € y 53.500 € brutos anuales para 2 habitaciones, pero con 40–60 días de vacante, comisiones OTA del 15–18 %, costes de limpieza altos (40–80 limpiezas al año) y desgaste fuerte. Un temporal en modelo full híbrido rinde 25.300–35.500 € brutos con 15–30 días de vacante, sólo 3–5 limpiezas al año y desgaste mínimo. Para un propietario sin VUT, el temporal es la mejor (y prácticamente única) ruta legal.

Can I get his temporary income up every year?

Yeah. Being outside the habitual housing LAU, it does not apply the end of the 2 % Annual. Each new temporary contract will be reached at market prices and the dynamic training system will be adjusted monthly as required by local demand.

What if a tenant wants to extend more than 11 months?

The temporary contract operates with a maximum practice of 11 months. If the tenant wants to stay more, we sign a new temporary contract with new justifiable cause or if the tenant's circumstances have been moved to permanent residence, a regular housing contract under LAU (that does give an obligatory extension) will be established. In practice, the initial filter prevents that situation: we work with profiles with clear output date from day one.

Can I combine the tidal with using the house myself sometimes?

Depende del perfil. Con corporate o estudiante de 6 meses, la casa está ocupada de forma continua durante ese periodo. Entre contratos sí tienes huecos de 5–15 días donde puedes usar la casa. Si quieres más flexibilidad de uso personal (4–8 semanas al año), un esquema mixto temporal+VUT (si tienes licencia) o un VUT puro te da más control — pero recuerda que en Justicia la VUT está prácticamente bloqueada para licencias nuevas.

Can it be published at Airbnb and Booking as a temporary rental?

Sí, totalmente legal. El registro único estatal (NRUA) que el RD 1312/2024 introdujo en 2025 fue anulado por el Tribunal Supremo en mayo de 2026, así que ya no es exigible. Lo único vigente es que, para publicar en Airbnb o Booking, estas plataformas exigen el número de registro turístico autonómico de tu comunidad (Reglamento UE 2024/1028) y retiran los anuncios sin él.
