Why Students Do That Fine for Your Housing in Madrid
Madrid concentrates the highest density of South European high-level elite programs. IE University at María de Molina, ESADE Madrid at Prince of Vergara, IESE at Pius XII campus, Copilas-ICADE / ICAI between Alberto Aguilera and Cantoblanco, CUNEF at Pyrenees, CEC St. Paul at Quevedo, EOI Cuatro Caminos, ESCP, EAE and the headquarters of the University of Navarra. What's temporary rental and why it's completely legal
Temporary rental is regulated at Section 3 of Act 29 / 1994 of Urban Leases as "rental for non-housing use." Madrid does not set minimum and maximum duration: what currently qualifies the contract as an attestation to a tenant Temporary cause to justify that the housing isn't his habitual residence. For this article, this cause are studies and is documented with valid registration, an employment contract or an Erasmus convention.
That legal architecture enables full hybrid model:: The same housing alternates academic course contracts (8-10 months) with shorter stay with Airbnb and Booking at the gaps, as long as the tenant remains with an attable temporary cause. What defines this figure isn't the duration but the documentation of the case.
Three relevant legal consequences:
- Freedom of pacts. Income, duration and conditions are set at market prices for each new contract. The end of the 2 % and the required five-year extension of the residential area do not apply.
- No tourist license. The rental of students operates under the LAU, and does not run under autonomous tourist regulations. The Special Hostiage Plan of the town council of Madrid doesn't affect him.
- Regional tourist registration (only if published on platforms). El alquiler temporal (art. 3 LAU) no necesita licencia ni número de registro turístico. El registro único estatal (NRUA) que el RD 1312/2024 introdujo en 2025 fue anulado por el Tribunal Supremo en mayo de 2026, así que ya no es exigible. The four sub-profiles within the student segment
There's no single profile within "students." The demand in Madrid is broken down into four segments with calendars, capacity to pay and different demands. To know what you're headed for changes potential rent and recruitment channels.
1. Private elite graduate (IE, ESADE, IESE, ICADE)
El segmento más rentable. Estudiantes de MBA, master in management, finance o law en escuelas de pago alto, con capacidad de pago muy superior a la media nacional. 2. MIR, FIR, EIR and PIR residents
Health care personnel with BOE assignment: guaranteed public salary during 4-5 years. The reference hospitals are spread throughout the city - San Carlos Clinic at Moncloa, La Paz at Castellana Norte, 12 de octubre at Carabanchel, Gregorio Marañón at Atocha- Retiro, Ramón and Cajal at Chamartin Norte, Princesa at Salamanca, Puerta de Hierro at Majadahonda, Niño Jesus at Retiro and Fundación Jiménez Díaz at Argüelles. Suelen buscar estancias largas en piso individual de 1–2 habitaciones cerca de Cantoblanco, Ciudad Universitaria o el centro investigador correspondiente. Perfil tranquilo, demandante en confort para teletrabajo y muy estable: a menudo renuevan dos o tres veces seguidas.
The best mix for a 2 flat rooms in university neighborhood: MIR or elite graduate from September to Junewith a 60-90 day in summer covered with Airbnb / Booking of passing professionals or with IE's own summer schools, ICADE or ESADE. Retiring Annual Occupation: 88 %-95 %.
+ Airbnb and Booking in gaps (full hybrid)
If housing is published on platforms with its autonomous registration, it goes legally Airbnb and Booking. Here we are talking about tourism: the guest who reserves sign an art contract. 3 LAU with attested temporary cause (studies, jobs, health, relocation). That allows us to cover June, July and part of August with short stay of professionals on an individual project, families visiting a patient or researchers invited to congresses. Renta temporal estudiantil es renta bruta media ponderada anual, asumiendo curso académico de 9 meses + 2–3 meses de estancias cortas vía Airbnb/Booking en verano. Applicable Regulation (April 2026)
Five points to fulfill at the foot of the letter as a student:
- Written contract with cause documented studies. Annex to the contract: copies of the centre's registration, MIR / FIR training residence contract, Erasmus agreement or letter of admission to a pre-doctoral programme. Without documentation of the case, a judge could reclassify his contract as a habitual rental with a compulsory extension of five years.
- Regional tourist registration (only if published on platforms). The single state registration was annulled by the Supreme Court in May of 2026 and what remains is that Airbnb and Booking demand an autonomous registration number from your community and withdraw an announcement without it (EU Regulation 2024 / 1028).
- Legal and additional collateral by profile. Two monthly bail (Section 36 LAU). For an elite graduate, international family guarantee or backup letter. To MIR, copies of the BOE name as collateral. For Erasmus, family guarantee and an additional monthly as an additional guarantee.
- Retention of the owner's IRPF. If the tenant is a natural person (habitual student's case), the owner declares his or her full income at his or her IRPF. If registration is paid by the father's / mother's company or a Foundation that signs the contract as a tenant, that legal entity applies retention of the 19 % using model 115.
- Community of owners. The LpH 17.12 allows you to veto tourist activity by 3 / 5 but temporary rental to students isn't tourist. If community statutes include specific restrictions prior to temporary use, they should be revised before signing them.

Toma la rentabilidad superior del segmento temporal (con Airbnb y Booking publicados legalmente, usando el registro autonómico que exigen las plataformas, en los huecos del calendario académico), añade la seguridad jurídica del contrato art. 3 LAU con causa documentada, mantiene el desgaste de la vivienda muy por debajo del VUT puro (2–4 inquilinos al año en lugar de 60) y se apoya en un perfil con aval verificable o sueldo público garantizado. El resultado: ingresos cercanos al 70 %–80 % de un VUT puro pero con la mitad de operativa, sin licencia turística y con un calendario que puedes planificar con seis meses de antelación.

Is a Airbnb more profitable than renting students in Madrid?
Depende del barrio y del propietario. Un VUT puro bien gestionado en Madrid centro genera 35.000–52.000 € brutos anuales para un piso de 2 habitaciones, pero implica 40–70 días de vacante, comisiones OTA del 15–18 %, 40–80 limpiezas al año y desgaste alto. Un temporal a estudiantes rinde 24.000–34.800 € brutos con sólo 15–35 días de vacante, 2–4 limpiezas anuales y desgaste bajo. En neto, el temporal estudiantil queda al 70 %–80 % del VUT, pero con muchísima menos operativa, sin licencia turística y con visibilidad de calendario a seis meses. La mayoría de propietarios que ponderan tiempo y desgaste eligen temporal estudiantil + huecos en plataformas.
Can I continue to pay the same if the next course drops demand?

Do you accept students that share a flat with several?
Sí, y de hecho es la modalidad más rentable para pisos de 2–3 habitaciones. El contrato lo firmamos con todos los inquilinos como solidarios, con aval familiar de cada uno. Cada habitación cobra renta individual cerrada con servicios incluidos (luz, agua, gas, internet). Esto permite cobrar 2.700–3.800 € totales en un piso de 3 habitaciones que en residencial rentaría 2.000–2.550 €.
Can you publish to students at Airbnb and Booking?
Sí. El alquiler temporal (art. 3 LAU) no necesita número de registro turístico; el registro único estatal fue anulado por el Tribunal Supremo en mayo de 2026. Si publicamos en Airbnb o Booking, estas exigen el número de registro turístico autonómico de tu comunidad, y una vez activo puedes captar reservas tanto largas (curso académico) como cortas (estancias entre cursos, summer schools, semanas de exámenes en hospital). Lo importante es que cualquier huésped firme contrato art. 3 LAU con causa temporal acreditable: estudios, trabajo, salud o traslado familiar. No es turismo, es arrendamiento por uso distinto del de vivienda.
