Málaga capital no admite viviendas de uso turística nuevas desde el 23 de agosto de 2025, y desde el 25 de julio de 2026 tampoco admite hoteles, hostales, pensiones ni apartamentos turísticos nuevos en suelo residencial. Ninguna de las dos suspensiones retira licencias ya concedidas: quien ya tiene una puede seguir operando y transmitirla al vender. Quien no tiene licencia no puede darse de alta mientras dure la suspensión —hasta tres años, o menos si se aprueba antes el nuevo PGOU— y la alternativa legal es el season rentalwithout a tourist license.

What's happened in Málaga and since when

Entre 2024 y 2026 el Ayuntamiento de Málaga ha ido cerrando la entrada de vivienda turística nueva en fases, no de golpe. La primera restricción llegó el 10 de junio de 2024, con la Instrucción 1/2024 de la Gerencia Municipal de Urbanismo: desde entonces, una vivienda solo puede darse de alta como turística si tiene acceso y suministros —luz, agua— totalmente independientes del resto del edificio. En la práctica, eso ya dejaba fuera a la mayoría de los pisos en bloques residenciales corrientes.

El siguiente paso fue por barrios. El 14 de enero de 2025 entró en vigor la modificación del PGOU que veta altas nuevas en los neighborhoods with tourist housing beyond the 8% residential park - 43 at first, including Centro Histórico, La Merced, La Malagueta, Perchel Norte and La Trinidad - with an intermediate regime for other 32 neighborhoods that approached that border. The 29 of May 2025 that neighborhood zoning was definitively approved.

23 August 2025 town hall leapt to the whole town term: Local Government Board suspended registration of Any new tourist housing in any neighborhood of town, con base en el artículo 6.2 del Decreto-ley 1/2025 de la Junta de Andalucía. El motivo que dio el propio Ayuntamiento: los barrios por encima del 8% de presión turística habían pasado de 43 a 53 en año y medio.

El paso más reciente amplía el freno más allá de la vivienda turística. El 16 de julio de 2026 el Pleno aprobó inicialmente la modificación pormenorizada nº 28 del PGOU: el uso de hospedaje deja de ser compatible o alternativo al uso residencial en todas las ordenanzas de la ciudad. Es una aprobación inicial, no definitiva, pero activó de inmediato una suspensión cautelar de licencias, publicada en el BOP el 24 de julio de 2026 y en vigor desde el 25 de julio. Esta vez la lista es más larga: hoteles, hostales, pensiones, albergues, apartamentos turísticos y vivienda de uso turístico en suelo residencial. Según la prensa local, la exención que se planteó para hoteles de 4 y 5 estrellas no llegó a incluirse en el texto aprobado.

The context helps to understand why the town hall has been tighting: Málaga is once again the province with more tourist housing in Spain, although the rate of growth has been slowed - from 16,89% at 2024 to 3,12% at 2025, according to information from the Board of Andalucía referred to by the local press - precisely by the combined effect of these measures and cancellations of licences for non-compliance.

What Can an Owner That Already Have License Do

Keep operating: The moratorium doesn't touch what's currently in place

Ninguna de las medidas de 2024, 2025 o 2026 retira licencias ya concedidas ni inscripciones ya practicadas en el Registro de Turismo de Andalucía. Todas hablan de altas new. Si tu vivienda está inscrita y cumple la normativa autonómica, puede seguir operando con normalidad mientras dure la suspensión —hasta tres años desde cada fecha, o menos si antes se aprueba definitivamente el planeamiento que la sustituye.

The obligations do not go away

Tener la licencia no es un trámite cerrado para siempre: hay que seguir cumpliendo el Decreto 31/2024 (aforo máximo, requisitos de la vivienda), publicar el código de registro en todos los anuncios y dar los partes de viajeros. Un incumplimiento puede acabar en la cancelación de la inscripción por parte de la Junta, con o sin moratoria de por medio: solo entre 2024 y 2025 la Junta canceló más de 3.800 viviendas turísticas en la provincia de Málaga, y a mediados de 2026 la prensa local situaba la cifra acumulada en unas 5.400. También hay expedientes municipales para cancelar licencias por incumplimientos de la normativa local; a finales de 2025 la prensa local informó de que el Ayuntamiento había dejado caducar administrativamente varios de esos expedientes, lo que en la práctica mantuvo esas inscripciones activas.

Transmit license if you sell

The leave does not travel with housing alone. If you sell, the new owner has to submit his own statement with the Tourist Delegation of the Junta de Andalucía and give up housing in the system ES. Hostidages and the salesman should leave his place. As long as housing continues to meet the same requirements - starting with independent access and supplies - and does not lead to a serious urban problem, the change of title should not be met with the current suspensions that block new high, but with an update of an earlier registration. That said: the complete file should be reviewed before buying or selling a "licensed" housing in Málaga, as the Administration can check after and the buyer inherits any irregularity.

The Owner Community

That's independent of the town's moratorium but affects the same: from 3's April 2025's reform of the Horizontal Property Act requires an agreement with three-fifths of owners and quotas to authorize the use of tourism in a horizontal-owned building and allows the community to ban it with the same majority. If your license goes ahead of that date, we should review the minutes and statutes: a community can vote for new restrictions ahead, but cannot act retroactively about those who have been operating legally.

What Can't Do Without a License - and What Can Do

Mientras dure la suspensión no se puede inscribir una vivienda de uso turístico nueva en Málaga capital, en ningún barrio. Tampoco se admite un hotel, hostal, pensión, albergue o apartamento turístico nuevo en suelo residencial desde el 25 de julio de 2026. Las solicitudes presentadas antes de cada suspensión siguen, según la prensa local, su tramitación ordinaria, pero cualquier expediente que se abra ahora se topa con el freno; conviene confirmar el estado concreto de una solicitud con un abogado urbanista antes de dar por hecho que sigue viva.

That doesn't mean that the housing has to be empty. The way out of tourist regulations is to season rental - also referred to as half-stay: a lease for a different use from that of habitual housing, intended for tenants who require housing for a given period and with a cause - work, studies, medical treatment, works in their habitual housing. No tourist license or registration with the Tourism Register, but a well-drafted contract and, according to the tenant's profile, more selection and collection work than a weekend guest.

Calendar: from here to 2029

La suspensión de agosto de 2025 tiene un tope de tres años —hasta agosto de 2028— o hasta que se apruebe antes la modificación del PGOU que la sustituye. La de julio de 2026 sigue la misma lógica, con tope en julio de 2029. En la práctica, el final real de cada suspensión no depende tanto del calendario como de cuándo el Ayuntamiento cierre la tramitación del nuevo PGOU: si se aprueba definitivamente antes, la moratoria termina antes, pero no para volver a la situación de 2023, sino para dar paso a las reglas nuevas —y previsiblemente más restrictivas— que motivaron la propia suspensión.

Can I leave my place as a tourist in Málaga capital right now?

No. Desde el 23 de agosto de 2025 no se admite ninguna vivienda de uso turístico nueva en ningún barrio de Málaga capital, y desde el 25 de julio de 2026 tampoco se admiten hoteles, hostales, pensiones, albergues ni apartamentos turísticos nuevos en suelo residencial. Ambas suspensiones tienen un tope de tres años o hasta que se apruebe antes el nuevo PGOU.

I have a license. Do I have something new about the moratorium?

Not directly. The moratorium blocks new high standards and does not withdraw licences or registration already granted. Still have to comply with Decree 31 / 2024, publish the registration code and put forward the passenger parts as before the moratorium.

Can I sell my place with the tourist license included?

The license isn't automatically passed with the sale: the buyer has to submit his own responsible statement and be discharged into ES. Hostiages, and the salesman should be discharged. If the housing continues to meet the requirements, the change of title should have no bearing on current suspensions but the file should be reviewed before signing.

Can my neighbor community ban tourist use even if I have a license?

Desde el 3 de abril de 2025 la comunidad puede prohibir el uso turístico con el acuerdo de tres quintos de propietarios y cuotas, pero ese acuerdo no puede aplicarse con carácter retroactivo a quien ya venía operando de forma legal antes de la votación.
