Why Malasaña works so well for temporary rental

Malasaña - an undertown and a centre district - concentrates about 50.000 inhabitants at a minimum radius. Piazza del Two de Mayo as an esicentro, streets such as Fuencarral, San Bernardo, Pez, Espivio Santo and Manuela Malasaña as a commercial and leisure vein. The neighborhood combines traditional residence with dense creative fabric: agencies, design studies, audiovisual producers, bookstores, specialty cafes, concerts. That mix attracts a very concrete professional profile - tech Founders, freelancers high- end, agency leading, round equipment - that needs accommodation from 3 to 6 months and doesn't fit into classical residential rental or a VUT.

To the gates has Moncloa-Argüelles with the central faculties of the UCM at a low km and to the south the master's and graduate network of the centre (ECAM, IED, EOI, schools of cinema and design). That brings the flow of senior and master's Erasmus with an academic calendar. In terms of health care, the Princess's Hospital remains at 10 minutes by Diego de León and the San Carlos Clinic at 15 by Moncloa: patients and middlestay accompaniments have Malasaña as one of their best choices for mobility.

The decisive thing: Malasaña is inside the PEH and also declared ZPAE for noise pollution. The issue of new VUT licences is practically blocked and many of them have been reviewed to a low level. All moved tourism demand is channelled to temporary rental with an attested cause, thus strengthening the market and increasing income. For an unlicensed VUT owner, temporary rental isn't a B plan: today's the main plan.

What's temporary rental and why it's completely legal

Temporary rental is defined at Section 3 of Act 29 / 1994 of Urban Leases as "rental for non-housing use." Madrid does not set minimum or maximum duration by law: The figure is not distorted by time but by Temporary cause That the tenant should have an attestation to explain that his or her place of residence isn't his or her habitual residence. The four challenges we accept and put into contract are jobs that have been moved, studies, medical treatment and family transport.

That's how the full hybrid model: The same housing can be operated with medium contracts (3-10 months) and, in gaps, with short stays using Airbnb and Booking as long as the guest holds an attable temporary cause. The key never's duration: it's documentation.

To the owner there are three key legal consequences:

  1. Freedom of pacts. You set rent, duration and conditions. Do not apply the end of the 2 % and the obligatory extension of 5 years of residential rental.
  2. No tourist license. Malasagna is blocked for new VUT (PEH, definitively approved 27 March 2019, BomC No 95, 23 April 2019, ZPAE from earlier) but temporary rental operates under the LAU and does not have an impact on them.
  3. Regional tourist registration (only if published on platforms). El alquiler temporal (art. 3 LAU) no necesita licencia ni número de registro turístico. El registro único estatal (NRUA) que el RD 1312/2024 introdujo en 2025 fue anulado por el Tribunal Supremo en mayo de 2026, así que ya no es exigible. Lo único vigente es que, si la vivienda se publica en Airbnb o Booking, estas exigen el número de registro turístico autonómico de tu comunidad (Reglamento UE 2024/1028), no el desaparecido registro estatal. The hybrid model: the four profiles that cover the year

The virtue of the hybrid model is that it does not rest on a single type of tenant. At Malasaña we articulate four segments with calendars and maintenance of operational housing throughout the year.

1. Creative and tech (3-6 months)

Founders at early stage, leading creative agency, freelancers high-end design and product, remote tech equipment that open office in Madrid. There's no private banking here - Malasaña's corporate demand is that of the creative and technological ecosystem. The average stay of 4 months, the tenant pays directly or through company and values the character of the floor above hotel equipment: views beams, hydraulic floor, balconies to Fuenccamino.

2. Erasmus senior, master's and schools (4-10 months)

A high and annual BMU Erasmus program (Moncloa-Argüelles to 1 km), global masters who value "living Madrid," long EOI and creative schools (ECAM, IED, schools of photography and cinema). Reportable family beam. Stages linked to the academic course (sept- May / sept- June). Low risk of default.

3. Patients and accompanying patients (1-4 months)

Aunque Malasaña no tiene hospitales propios, la conexión con el Hospital de la Princesa (10 min) y el Clínico San Carlos (15 min) es directa. Familias y pacientes que prefieren un barrio con vida, comercio de proximidad y oferta gastronómica para acompañantes durante la fase de tratamiento. Estancias 1–4 meses, perfil cuidadoso, prepago.

4. families and professionals in transit (1-3 months)

Reforms (Malasaña has an old built park in full wave of rehabilitation), cultural transfers, audiovisual professionals with films from 2-3 months (producers, streaming platforms filming in Madrid), technical staff from theatres and festivals. A short but stable profile.

+ Airbnb and Booking in gaps (full hybrid)

If housing is published on platforms with its autoeconomic registration, it also goes to Airbnb and Booking completely legally. The difference with a pure VUT is that at temporary rental the guest continues to sign an art contract. 3 LAU with justifiable time cause - isn't tourism. That allows to complete the weeks between two long contracts with short stay (5 days to 3 weeks) of shooting equipment, freelancers on an individual project, families visiting patient or festival equipment. Result: employment close to 100 % and an additional income without a tourist license - something especially valuable in Malasaña, where pure VUT is no longer an option.

Renta temporal es renta bruta media ponderada anual (mezcla de los cuatro perfiles). El diferencial neto tras gestión y gastos depende del modelo: en Gestión Integral de Bliss Homes la comisión media en alquiler temporal está en el 15–18 %+IVA; los gastos operativos (limpiezas entre inquilinos, suministros, mantenimiento menor) suman un 6–10 % según uso.

Regulation applicable to Malasaña (May 2026)

These are the points that should be met at the foot of the letter:

  • A contract with an attestable temporary cause. The determining requirement in Madrid: The cause (work, studies, health and family transfer) has to appear in the contract and, where this can be documented (letter from the company, registration from the centre, medical proof and work). No minimum or maximum duration by law. What deludes the figure is the cause. Without a documented cause, a judge could reclassify his contract as a habitual housing.
  • Regional tourist registration (only if published on platforms). The single state registration was annulled by the Supreme Court in May of 2026 and what remains is that Airbnb and Booking demand an autonomous registration number from your community and withdraw an announcement without it (EU Regulation 2024 / 1028).
  • Legal liability and additional guarantees. Two monthly leave (Section 36 LAU) and, as recommended, an additional guarantee by profile: corporate bank or family collateral with an address in Spain for graduate.
  • Retention of the owner's IRPF. If a tenant is a legal person (company, production and agency), his or her 19 % retention of his or her income and his or her entry into his or her office with his or her model 115. If you are a natural person, the rent is declared as complete by the owner.
  • Community of owners. Article 17.12 LpH only allows to veto tourist activity by a majority of 3 / 5 and temporary rental isn't tourism, so you can't veto them by that way. The statutes should be revised if there's an earlier specific clause - in Malasaña's buildings with many years old, it's not rare to find old internal standards.

How we work at Malasaña: complete process

From sign to first tenant, our standard process is 15-21 days.

  1. Visits and valuation. Let's go to the ground, we measure real demand in the next streets and we look at which of the four profiles dominates your portal (it's not the same Holy Spirit about May Two as St. Bernardo near Glenette of Bilbao).
  2. Equipment. If the flat is empty or lacks a few rooms, we give detailed list with budget (1.500-4.000 € for 2) and we will buy and assemble if you prefer. At Malasaña character commands: better to maintain the original hydraulic ground than to cover it with tidal.
  3. Autonomous registration (if we publish on platforms) and professional photography. If the floor will be advertised at Airbnb or Booking, we process the number of autonomous tourist registration required by the platforms, in parallel with the photo session (3 days). The photos are decisive: the guest will reserve without visiting and, in this neighborhood, what you will see are atmosphere, light, balconies, non-generic IKEA furniture.
  4. Multichannel publication. Airbnb and Booking (with the autophone registration they demand), direct channel Bliss Homes and network of audiovisual producers and creative agencies that rotate equipment throughout Madrid. We set up the platforms so that they only accept reservations with a time-proof and minimum duration consistent with your mix goal.
  5. Filling and recruitment. Identification check, solvency and temporary cause. A contract drafted by our legal advice. Loan and, as appropriate, additional collateral.
  6. Ongoing management. Cleaning among tenants, monthly training with pricelabs, care in Spanish and English, monthly report to the owner, search for the next candidate 30 days before the end of contract.

Honest comparison: temporary vs. tourist vs. residential in Malasaña

The full model hybrid temporary rental He's the one with all the good parts of his cake and his bad ones. It takes the high profitability of the tourist (with Airbnb and Booking published legally, using the autonomous registration required by the platforms and short stays in gaps), the residential's legal security (signed contract, deposited bail, filtered profile, with no risk of habitual okumpation) and the operational stability of have 3-5 tenants a year instead of 60. Result: income close to pure VUT, very high maintenance (low rotation = less wear, less cleanliness, less malfunctions), minimum legal risk and a proactively managed schedule. At Malasaña, where the VUT license is virtually unattainable today, the full hybrid model is directly the only way to capture the area's bonus without operating outside the law.

Can I get his temporary income up every year?

In Malasaña, the initial filter - creative with closed project, postgraduate with defined course, films with intended duration - prevents this situation.

Can I have a combination with me using the house sometimes?

Depende del perfil. Con un creativo o postgrado de 6 meses la casa está ocupada continuamente en ese período. Entre contratos sí tienes huecos de 5–15 días donde puedes usarla. Si necesitas máxima flexibilidad (uso propio 4–8 semanas al año), el modelo no es el mejor para ti — pero como en Malasaña la VUT pura ya no es opción, el temporal sigue siendo la vía rentable.

Can it be published at Airbnb and Booking as a temporary rental?

Sí, totalmente legal. El alquiler temporal (art. 3 LAU) no necesita número de registro turístico; el registro único estatal fue anulado por el Tribunal Supremo en mayo de 2026.
