Desde el 29 de octubre de 2024, Sevilla no admite más VUT en los barrios que ya superan el 10 % de su parque de viviendas: once barrios, entre ellos Centro Histórico, Santa Cruz y Triana, están en esta situación. En barrios con menos del 10 % —como Nervión, Macarena, o zonas del distrito Este y Bellavista-La Palmera— sigue siendo posible dar de alta una VUT, con cambio de uso a terciario-hospedaje, planta baja o primera y acuerdo de la comunidad de propietarios. Quien ya tiene licencia puede seguir operando y transmitirla, pero con más fricción que antes de 2024: hace falta nueva declaración responsable, reinscripción en el RTA y, para cambiar de titular, el acuerdo de la comunidad.

What's happened and since when

Seville was the first great Spanish town to set a figure top by neighborhood for tourist housing. The VUT limitation order entered into force 29 October 2024as confirmed by Town Planning Managementand lays down a maximum of the 10 % of houses intended for tourist use about the total residential park of each of the 108 neighborhoods of the city. Eleven neighborhoods have been above that level at the time of passing the norm and have been focused mainly at the historic centre, Santa Cruz and Triana and no new high schools have been allowed since.

The town is effectively divided into three saturation levels: high (Center, Triana), where the ceiling's already exceeded. medium (Nervion, Macarena) with limited range and low (This, Bellavista - La Palmera), where there are still tours for new heights. The autonomous framework has also been in the same direction: Decree-law 1 / 2025 de la Junta de Andalucía (en vigor desde el 3 de abril de 2025) permite a los ayuntamientos suspender altas hasta 3 años, eleva las sanciones hasta 600.000 € y exige acuerdo de 3/5 de la comunidad de propietarios para autorizar VUT nuevas. La CNMC He questioned in April of 2026, in a non-binding report, that the sevillian ordinance requires change of use to tertiary - accommodation with no explicit coverage at the PGOU but the municipal criterion remains as long as it remains unchanged.

The result of two years of ordenance is a market that has been more but less reordered: about an active 9.592 VUT park, 1.422 have been cancelled from 2024, mainly in the neighborhoods that exceeded the top, while new high jobs have been continued to be handled in remote neighborhoods. It's a model that should be taken into account before assuming that "Seville's closed": what's closed up are some very concrete neighborhoods, not the whole town.

What can you do if you have a license

  • Maintain activity in the neighborhood where that neighborhood is or isn't above 10 %. The ceiling affects high new ones and does not revoke existing licences.
  • Transmit or sell with licensebut with more friction than before 2024: a new statement with responsibility, re-registration with the Tourism Register of Andalucía (RTA) and an agreement with the owners community for change are required to change.
  • Monitoring the owners community. Since 3's April 2025, a community can demand a majority of 3 / 5 to authorize new VUT, and can also vote against keeping existing ones under what statutory terms. The final minutes should be reviewed before considering that the license is free from a future community agreement.
  • Keep RTA and SES.HOSPEDIJES.up to date. La Junta de Andalucía ha cancelado más de 13.000 VUT del RTA entre 2024 y 2026 (2.673 solo entre enero y mayo de 2026) por incumplimientos administrativos; mantener la inscripción y la comunicación de huéspedes al día es lo que evita entrar en ese lote.
  • Consider the change of tertiary use - accommodation if your neighborhood is under 10 %. That's the requirement for an ordinance to release or maintain a VUT dispersed ground or first floor outside saturated neighborhoods.
  • To closely monitor the appeal with CNMC. If the competition agency ends up forcing a review of the tertiary-use change criterion, the requirement to release from middle- and low-saturation neighborhoods may change in the coming months, and it is unlikely to have an impact on licences already granted but it can open or close leave in currently border areas.

What Can't Do Without A License, and The Legal Alternative

En los barrios que todavía no han llegado al tope, sí es posible, siempre con declaración responsable, cambio de uso terciario-hospedaje, planta baja o primera, al menos 25 m², climatización, inscripción en el RTA y acuerdo de comunidad de 3/5.

The town and town's water company, Emasesa, have been strengthening enforcement: cuts have been applied to irregular tourist housing at least six times and the Board itself have cancelled thousands of RTA VUT throughout Andalucía in the last two years. Operating without cover in a saturated neighborhood isn't a medium term track.

The Board of Andalucía has also been strengthening its monitoring from the autonomous side: between 2024 and 2026 cancelled more of 13.000 VUT from the Tourism Registry throughout the community with 2.673 low only between January and May of 2026. Seville is no exception to this trend, so keeping registration with RTA up to date - renovations, holder changes, data communication - is as important to avoid losing the license as meeting the area top at the time of release.

Where high tourism is closed, the legal alternative is season rental: lease without a tourist licence for work, studies or health care, as regulated by Article 3.2 of the LAU. It allows to continue generating income with the property at the Centre, Santa Cruz or Triana without dependent on a quota that's already closed.

Calendario 2026-2028

  • 29 October 2024: The VUT limitation order with the 10 %'s top by neighborhood enters into force.
  • 3 April 2025: The Act 1 / 2025 andaluz (municipal suspension up to 3 years, sanctions up to 600.000 €, 3 / 5 community agreement) entered into force.
  • 24 January 2026: entra en vigor la Ley 5/2025 de Vivienda de Andalucía, que prohíbe destinar VPP a uso turístico.
  • April of 2026: NCMC's non-binding report questioning the demand for a change of tertiary use without coverage of the UGN and without an immediate effect on the ordinance.
  • No date: The sevilan pSOE calls for a complete moratorium at the centre. PP and Vox argue that the 10 %'s margin is currently practically exhausted in central neighborhoods.

My VUT at Seville's centre remains valid even though the neighborhood is above the 10 %?

Yeah. The 10 % top affects high news from 29's October 2024 top, and does not affect the licenses already granted before that date or before the neighborhood reached its top.

Can I transmit my VUT license to a buyer in Seville?

Yes, but with more procedure than before 2024: a new responsible statement is necessary in the name of the new owner, re-registration with RTA and an agreement with the owners community for the change of title.

What exactly does the change of tertiary use mean - accommodation?

That's the urban demand that the sevillan ordinance requires so that a house scattered on the ground or first floor can operate as VUT outside the already saturated neighborhoods. Without that change of use, the responsible statement is valid.

Can the community of owners stop my VUT if I have been discharged?

The Decreto- law 1 / 2025 requires an agreement with 3 / 5 from the community to authorize new VUT from April 2025. For those currently in place, it was necessary to revise the statutes and recent minutes: different communities had begun to vote for restrictions to come.

My place's in a neighborhood with an exhausted top. What choice do I have?

Seasonal rental, regulated by article 3.2 of the LAU: rental contract without tourist license, for jobs, studies or health. It's the legal way to continue to rent the property in a closed neighborhood to VUT.
