At Extremadura there is no dedicated housing order for tourist use: it's treated as a tourist apartment under the 182 / 2012 Decree with classification by category up to 4 keys. It's one of the most stable frameworks in Spain with no moratoriums or restricted zones in place in the region, but it's useful to check the order of the particular municipality. The apartment is commercialised as a complete unit, not for single rooms.
The extremist peculiarity: No VUT's own decree
The first mistake that nearly every owner who looks for "VUT's decree of Extremadura "is to avoid finding him, because it doesn't exist as an independent figure. The Board Extremadura has opted for a different model from that of communities such as Madrid and Andalucía: Instead to create a separate legal category for housing for tourist use, and these properties at the figure of the tourist apartmentwith all its technical requirements, and procedure.
In practice this means that, if you rent turistically a complete housing Extremadura, the legal framework applying to you is the same as that regulating apartments tourism: 182 / 2012 Decree of 7 September. No legal vacuum - al otherwise, the regime is detailed - but we have to understand from the start that you are operating under the figure of "tourist apartment," not under an independent VUT.
Current policy framework at Extremadura
Framework rule defining establishments Extrachoteleros tourism - including tourist apartments -, the declaration regime the General Register of Companies and Tourist Activities of Extremadura and That's how it's been.
- 182 / 2012 Decree, 7 September establishing management and classification of the tourist apartments of the Autonomous Community of Extremadura (DOE No 178 from 13 September 2012). It repealed the previous Decree 88 / 2007 and was the reference technical norm: defines categories, housing unit requirements, activity start procedure and procedure Retirement.
- Decreto 205/2012, de 15 de octubre, regulating the operation and registration with the General Registry of Companies and Tourist Activities of Extremadura.
To this are added, as in the rest of Spain, two layers of state:
- Ley Orgánica 1/2025, de 2 de enero, amending Section 17.12 of the Act Horizontal Property. From 3's April 2025, the agreement by which a community of owners approve, limit, condition or prohibit the tourist use of a flat requires a vote and 3 / 5 parts and participation quotas.
- A single state registry (NRA / NRUA): procedure annulled. The Royal Decree 1312 / 2024 established a single state registration procedure but the Judgment of 19 Supreme Court May 2026 It annulled the precepts concerning proceedings for lack of State competence. The valid identifier that the platforms have been required to demand an autonomous registration number in the General Register of Companies and Tourist Activities of Extremadura.
182 / 2012: key categories
The 182 / 2012 Decree classifies tourist apartments at cuatro categorías identificadas mediante llaves (de una a cuatro), en función de la calidad de instalaciones, materiales y servicios. Los requisitos técnicos más relevantes son:
- Minimum composition: living room-dining room, a bedroom, a bathroom and a kitchen (art. 16) with the exception of studio apartments with up to two people.
- Minimum height of ceilings: 2,5 Meter with specific rules for ceilings malnourished (Section 16.5).
- Fan and dusk (Article 18): the bedrooms and living room have a direct ventilation to the outside and have a dark system that prevents light entry.
- Bathing rooms (Section 17): equipped with hot and cold water, sink, bath or shower, toilet and basic accessories. A second bath with a number of jobs by category.
- Equipment (art. 19): furniture, crockery and bed linen consistent with category; equipped kitchen with sink, extractor, kitchen or ceramic, refrigerator and care and laundry, shared or individual with category.
- Placa distintiva (art. 8): required at main entrance with characteristic of Annex II to the Decree.
Decree 182 / 2012 isn't intended for the assignment of single rooms: tourist apartment as a complete housing unit that is offered as an ensemble.
The step by step procedure
The registration number follows the typology and province nomenclature: the properties situated in the province of Cáceres they get a code with prefix AT-CCand those of Badajoz province, AT-BA. That number should appear throughout advertising and a marketing channel.
Why does Extremadura have no moratoriums or restricted zones
Unlike communities with strong tourist pressures - Catalonia, Andalusia, Balearic Islands or The Canary Islands -, Extremadura has so far adopted no autonomous moratorium and no zoning that limits the opening of new apartments or tourist houses. The Decree 182 / 2012 contains no territorial limitations and neither the Extremadura Board nor the main municipalities - including Merida and Cáceres - have approved urban plans that veto or restrict activity at their historic helmets.
That makes Extremadura one of the most stable and predictable autonomous frameworks of Spain with a view to processing a tourist housing, but we should always check the order concrete town before investing as a town hall can introduce its own requirements Any second.
How much it costs to get his license out at Extremadura
The autonomous declaration of responsibility does not, in most cases, give an important rate by itself. The actual costs come from technical documentation and adjustments that require the chosen category:
- Municipal opening leave: variable by town.
- Retirement plans signed by technical: 150-400 €.
- Civil liability policy: Annual cost variable by insurer and capacity.
- Energy certificate: 60-150 €.
- Fully dark systems in bedrooms: requisito del art.
- Minimum housing equipment: from 0 € (if currently equipped) to several thousands of euro for complete equipment, depending on the category for keys requested.
- Management fees (if supported): 250-600 € only once.
In guaranteed rental model with Bliss Homes, all these costs are assumed by Bliss. The Owner doesn't advance anything.
Common errors that delay or reject registration
- Search "VUT's Decree" and don't find him.
- Do not fulfill the total darkening system in bedrooms. Es requisito expreso del art. 18.2 del Decreto y se inspecciona.
- Do not have permission from the owners community. Since April 2025 (LO 1 / 2025), a flat with a horizontal property cannot operate turistically without express agreement by majority of 3 / 5.
- Do not include the registration number (AT-CC / AT-BA) in advertising. It's and after the cancellation of the single state registry, it is the identifier that Platforms are still required to demand.
- To merge an apartment with VUT from other communities. The regime Expand is more demanding in category classification (keys) than other models autoponics of pure responsible declaration.
- Do not check the town order. Although there are no autonomous moratorium, every town hall can introduce its own opening or changing license requirements.
Retirement regime in Extremadura
