El centro histórico de Granada —Albaicín (24 %), Fígares-Ronda (24 %), Centro-Sagrario (23 %) y Realejo (13 %)— tiene un límite del 10 % de VUT por zona fijado en la innovación del PGOU, y varios barrios ya lo superan ampliamente. El acuerdo municipal de julio de 2024 que reforzaba estos criterios fue anulado por el TSJA en 2026 y está en casación, lo que deja el alta en el centro en una situación de inseguridad jurídica real, no de prohibición formal. En Zaidín, Chana, Beiro y el resto de la periferia, el alta sigue siendo posible. La vía que más ha crecido en el centro no es la VUT dispersa, sino el edificio completo reconvertido a uso hotelero.

What's happened and since when

Grenada has built its limit to tourist housing into two layers that are currently partially conflict with each other. The first is GOU innovationand with an initial approval of 31 of January 2025, final approval of 30 of May 2025 and published at BOP 28 July 2025. Set a border of VUT's 10 % by area, with a historic centre divided into several fields: Albaizo and FIGAREN-Ronda and 24 %, 23 %'s Parish and 13 %'s Realejo. The 10 % have been set as a top.

The second cape is the July 2024 Plenary AgreementThat was strengthening these criteria by requiring independent inputs and supplies for any new VUT and that in practice led town council to reject close to 99 % of applications submitted under that criterion. That agreement was anulado por el TSJA entre abril y mayo de 2026and the matter is currently under review. The result is that the most restrictive criterion applied by the town council to deny licenses at the centre has lost judicial support but the innovation of the pGOU with the 10 %'s top remains formally valid and amicably established after its publication at BOP. In practice, this leaves an end to the historic centre in a situation of legal uncertainty, and not an absolute blockade and free track.

Esta ambigüedad tiene un efecto muy concreto sobre cualquier operación en marcha: una solicitud presentada hoy en el Albaicín puede resolverse con el criterio más laxo derivado de la anulación del Acuerdo de 2024, o con el tope del 10 % de la innovación del PGOU, que ese mismo barrio ya supera con holgura. No hay un criterio único y estable hasta que la casación se resuelva, así que cualquier decisión de compra o inversión en el centro histórico de Granada debe partir de que el escenario puede cambiar antes de que termine el trámite administrativo.

What can you do if you have a license

  • Maintain activity con la licencia que ya tenga, tanto en el centro como en la periferia. Ni la innovación del PGOU ni la anulación judicial del Acuerdo de 2024 tienen efecto retroactivo sobre licencias ya concedidas.
  • To transport housing with relative ease. Unlike other Andalusian cities, the transmission of the licence in Granada only requires communication without a complete new procedure. What does require an explicit agreement from the owners community is a change of title for other neighbours as treated by the Owners Board between August and September of 2025.
  • To monitor the current dispute. Until an appeal with respect to the 2024 Agreement has been decided, any VUT currently undergoing proceedings at the centre is subject to a criterion that can be altered and all documentation of the original application should be kept if rights have been established.
  • To fulfill RTA and SES.HOSPEDAJES as with any remote VUT, regardless of whether the license is before or after the innovation of the PGOU.
  • To document the exact date of release. En un contexto de litigio abierto, poder acreditar con precisión cuándo se concedió la licencia y bajo qué criterio urbanístico es la mejor defensa frente a cualquier revisión futura, tanto si el criterio de 2024 vuelve a aplicarse como si no.

What Can't Do Without A License, and The Legal Alternative

If your housing is at Albatín, FIGAREN-Ronda or Central-Sagrarius, the 10 %'s top of innovation at the PGOU is currently widely exceeded and while the 2024's strengthening of the criterion was nullifying, in practice the town council continues to operate with high care in these areas while the appeals are resolved. Realejo, with a 13 %, is in a similar but somewhat less extreme situation. At Zaidín, Chana, Ronda peripherica and Beiro, tipping remains possible without the same area restrictions.

Those who cannot release a VUT scattered at the centre have an alternative path that has grown noticeably: complete building converted to hotel use. More than 180 downtown buildings have been moved to this figure and more from 90 % of new work in historic areas from 2024 directly challenges as hotel accommodation, not as scattered VUT. That's the way that today has a real ride in the centre of Granada, though it requires to buy or convert the whole building, not a loose floor.

The reason this track has grown so much in Granada is simple: a complete building intended for accommodation does not compete for the same area quota as the scattered VUT, nor does it depend on the contentious criterion of the 2024 Agreement, because it is directly treated as hotel use from the project. It's an explanation that more of the 90 %'s new work in historic areas from 2024 will come up under this figure, rather than as a scattered tourist housing.

For those with a loose flat at the centre and cannot choose the hotel path, the alternative is season rental: rental contract without a tourist licence, as regulated by Section 3.2 of the AU, for work and health care.

Calendario 2026-2028

  • 31 January 2025: initial approval of pGOU innovation with the 10 % top by area.
  • 30 May 2025: final approval of the GOU's innovation.
  • 28 July 2025: published at the BOP and an ambiguous legal consolidation about its exact scope.
  • May of 2026: The TSJA cancels the July 2024 Plenary Agreement and appeals are currently under way.
  • No date: That decision shall determine whether 2024's restrictive criterion can be re-applied or whether the centre's margin will be enlarged.

FAQ

Is my VUT still valid at the Albaicín if it's been discharged?

Yeah. Neither the innovation of the GOU nor the judicial cancellation of the 2024 Agreement retroactively affects the licences already granted. The normative conflict affects new applications.

Can I transmit my VUT license to a buyer in Granada?

Yes, and with less procedure than other Andalusian cities: communication with the registry will be sufficient. For a change of title with respect to the owners community, an explicit agreement may be required, as per the statutes of each farm.

¿Por qué hay tanta incertidumbre en el centro si el Acuerdo de 2024 fue anulado?
