El registro turístico y el registro de viajeros (SES.Hospedajes) son obligaciones distintas y ambas siguen vigentes.

The division of skills: three overlapping levels

The first mistake of many owners is to seek "the law" of tourist rental, singular. No one: tres capas que se solapan.

  • State: sets cross-cutting things (taxation, passenger communication, interplatform co-ordination) but does not issue a tourist license.
  • Autonomy: That's what really regulates housing for tourist use, defines the requirements and grants registration code without which you cannot announce.
  • Municipal: through urban planning can restrict, condition or directly veto new tourist housing in some areas (call moratoriums).

That's why a perfectly legal housing in a town can be impossible to give up at the centre of a great town: same community and different municipality.

The single state register: entered 2025, was annulled by the Supreme at 2026

The record that's valid: the autophone, sign by sign

Each community has its own register of tourist housing, its procedure and its acronyms. These are the most common:

The general procedure in most of them is the Responsible statement before the autonomous tourist administration: you have the documentation, get a registration number and you can already operate. That general rule, however, has more and more exceptions and the most sound is Canary Islands.

Canary Islands: The Highest Hardening (Act 6 / 2025)

If there's a community where regulations have been transformed at the root, it's Canary Islands. The 6 / 2025 Act of 10 of December of Sustainable Management of Housing Tourist Use (in force since 13 December 2025) as an essential substitute for the old Decree 113 / 2015 and changes the paradigm: the tourist use of housing ceases to be a liberalised activity and becomes an and planned. Among its key points:

  • Prior urban planning and compatibility with local and island planning.
  • Minimum age of 10 building (reduced to 5 years in El Hierro, La Gomera, La Palma and municipalities of the demographic challenge).
  • One minimum residential maintenance That leave an approximate maximum of 10% for tourist use by area (with a 80% ground that can be applied to green islands).
  • A Transitional arrangements for housing currently authorized under Decree 113 / 2015 with long term consolidation.

Municipal Moratoriums: When the problem isn't the community, it's the town

Beyond the autonomous regulations, several municipalities have put an end to high news in their most tense areas through urban planning. That's true, with different approaches and degrees, of cities such as Madrid, Barcelona, San Sebastian, Palma, Seville, Málaga or Valenciawhere to get a new license at the centre can be very difficult or directly impossible. These restrictions often change, so we have to confirm the situation of the specific district before buying or applying. The market result is the same as in the Canary Islands: the licences already granted and currently in place become a smaller asset.

Tourist registration vs. Traveller registration: aren't the same

That's the most repeated confusion. They're two different obligations and have one without the other:

  • Regional tourist registration (VUT, VV, HUT, ETC, VFT...): enabling you to and operations housing. That's your community's competition.
  • Passenger registration: information about your guests before The Ministry of Internal Affairs through the SES platform. Hostiages. It's state and security and remains fully valid.

That the single state registry tourism and nullifies have nothing to do with registration of Travellers: they are different things with different aims.

What all this means to you as an owner

Three ideas to avoid missing in noise:

  • Look at your community, not "state law." What's enabling you is your region's registration code.
  • Check town. Even if the community permits, your town hall can have a moratorium in your area.
  • Keep them both up to date. The tourist to advertise and that of passengers for each stay.

Is there still a single state register of tourist rental at 2026?

No como obligación general. El registro único estatal (NRUA o "número de registro de alquiler") que arrancó con efectos desde el 1 de julio de 2025 fue anulado por el Tribunal Supremo mediante sentencia de mayo de 2026. What tourist registration do I require according to my autonomous community?

It depends on the region: VUT in Madrid, Galicia, CyL, Aragon, Cantabria and Basque Country, VV in Canary Islands, Asturias and CLM, HUT in Catalonia and VFT in Andalucía and ETC in Balearic Islands and VT / VUT in the Valencia and Navarra communities. The usual procedure is a responsible statement to the autonomous tourism administration, except where it has been tightened with authorisations or ceilings.

What community has tightened regulations more at 2025-2026?

Canarias, con la Ley 6/2025, de 10 de diciembre (en vigor desde el 13 de diciembre de 2025): habilitación urbanística previa, antigüedad mínima del edificio de 10 años (5 en las islas verdes) y reserva del uso residencial que deja un máximo aproximado del 10% para uso turístico por zona. The Traveller's Record (ES. Hostidajes) is the same as the tourist register?

No. The autonomous tourist register enables you to propose and operate and the registration of passengers (Ministry of the Interior, ES platform). Hostidajes) consists of communicating information about your guests at each stay. Both are obligatory and independent.

Do I need a different license in every community if I have housing in several?

Yeah. The competition is autonomous and municipal, so every house complies with the regulations of place and gets its own registration code in that community. There's no code for the whole country.
