Before looking at a hostel's jield, see if you can blow it up. The expensive bug of the investor arriving from the residential is to treat the license as a paper that's signed at the end. In accommodation, the legal figure - hostel, retirement or guest's house - and its classification determine the adequacy capex, equipment requirements, taxation and up to the value of the asset at resale. Buying bad here doesn't give up a few tenths of profitability: you can leave a property that cannot be operated as what you paid.

That article translates Regulation into an investment criterion. It's not a processing guide: it's the viability filter we apply before the deal goes to number.

No state hostel license: the autonomous community commands

The first conceptual trap is to seek "the hostel license in Spain." It doesn't exist. The planning of hotel establishments was transferred to the autonomous communities and each had its own decree. What in Madrid is a hostel of a star, in Andalucía is classified with another logic and what in one region requires reception 24h, in another no.

The only common framework is the reference threshold for the concept. A hostel is widely defined as a pension with more than 20 accommodation and a minimum of 10 rooms (Consumbeca / Lodgify). Under that size, we usually talk about board or guest house. But the exact number, the name and the category are set by the autonomous norm, so the first step of due diligence is to read the decree of the particular region, and not a generic article.

The practical result for the investor: a same building can be more or less valid according to the figure under which they are classified, and a change of community means to re-start regulatory analysis from zero.

Star classification: Madrid yes, Andalucía no (true examples)

The question "does a hostel have stars?" has no national answer. Two opposite examples that cover much of the investment map:

Madrid (Decree 19 / 2023). It sets up three groups. The second group includes pensions and hostels with categories of 1, 2 and 3 stars. guest housewithout category by star, for establishment that does not reach the levels to be classified (Decreto 19/2023, BOCM 22-mar-2023). The guest house should have heating, hot water and a bathroom for every three rooms: material requirements that the investor translates directly to capex.

Andalucía (Decree 47 / 2004 and its subsequent evolution). The guest group has been classified by group's own categories - without the extensive gradation of hotel stars - and single category pensions (Decree 47 / 2004, BOJA). The logic of classification was different from that of Madrid and the Andalusian regulations had been modified in recent years and the current version should be confirmed before closing.

Why it matters to underwriting: The category isn't marketing. It lays down minimum equipment requirements (toilets per room, surfaces, services) that are direct investment and conditions the market's price for the asset. To get up from category can be a value lever -add; to get down from what's been promised in the announcement is a risk that you have to discount before signing.

The three guest figures, seen as an investor

The same building can fit into different figures. The choice changes capex, requirements and valuation:

YES. Hosting: compliance that's no longer optional

Desde el 2 de diciembre de 2024, comunicar el registro de viajeros a través de la plataforma YES. Hostiages of the Ministry of Internal Affairs is required for all accommodation establishments, according to RD 933 / 2021 (RD 933 / 2021, in force since ddd.2024). La obligación incluye enviar los datos de cada huésped en un plazo de 24 horas y conservarlos durante tres años. El incumplimiento se sanciona conforme a la Ley Orgánica 4/2015 de seguridad ciudadana, con multas que van desde cientos hasta decenas de miles de euros según la gravedad.

For the investor, this translates into two things. First, a recurrent operational costs: integration with ES. Hostiages (using pms or check-in software) should be solved and maintained. Second, a Due diligence point: When buying a hostel currently under way we have to check that compliance is up to date, because an inherited sanction or a fragile manual process is a liability. In practice, this is just the kind of burden a professional management absorbs without the owner having to think about.

The license as a viability filter, but as a procedure

A hostel can have an attractive number about paper and be, however, a bad buy if the regulation does not come with them. The three points where most deals fall into our experience:

1. Urban use

The building should allow for the use of accommodation as planned by the town. A property with pure residential use does not become a hostel for wanting it: compatibility of use and sometimes a change of qualification are necessary. It's the first "No" to be ruled out before any offer.

2. Transfer of leave

If you buy an operating company, authorisations are usually followed by an operator. If you buy only the property, you normally have to re-conduct the responsible declaration and check that the activity remains feasible under the current rule. A license that cannot be kept empty the investment case.

3. Regulatory risk by area

Although the hostel isn't a VUT, it isn't immune to normative tightening. Cities such as Barcelona (end of VT licences at 2028) or Madrid (Plan RESIDE) mark a restrictive direction that should be mapped. The state frame also moves: the single state register (RD 1312 / 2024) was cancelled by the STS 620 / 2026 and remains valid the autonomous code (verificar BOE-A-2024-26931 y STS 620/2026).

From leave to return: why the classification does not decide profitability alone

That's why the right order of analysis is: (1) valid license and classification → (2) underwriting with actual figures → (3) operation that defends the margin. The most undervalued share of the investor is the third.

Operating the hostel: professional management vs. regular canon vs.. Self-management

  • Check transferability of the license according to the structure (purchase of company vs. building).
  • Audit compliance with ES. Hostiages and of the declared category: that what's been announced coincides with what's been registered.
  • Models the cascade of euro with real local figure before accepting the announcement's jield.
  • Decides who operates: the difference between ~ 35-40%'s occupation of passive range and a professional operation is the case with an investment.
